EAPO Representatives Participated in Ratification Proceedings in Kazakhstan

On June 10, 2020 a videoconference meeting of the working group of the Committee on Legislation and Judicial and Legal Reform of the Mazhilis of the Parliament of the Republic of Kazakhstan was held to discuss the Draft Law of the Republic of Kazakhstan “On Ratification of the Protocol on the Protection of Industrial Designs to the Eurasian Patent Convention dated September 9, 1994”.

Representatives of the Eurasian Patent Office, the Supreme Court of the Republic of Kazakhstan, the Ministry of Justice of the Republic of Kazakhstan, the National Institute of Intellectual Property of the Ministry of Justice of the Republic of Kazakhstan, and patent attorneys took part in the meeting.

During the presentation of the Draft Law the participants discussed issues related to the Eurasian regional system of legal protection of industrial designs. In particular, opportunities for Kazakhstan applicants for regional protection of industrial designs, details of concurrent engagement of the Eurasian system and the Hague system for international registration of industrial designs, issues of disposal of rights to Eurasian industrial designs were considered. Representatives of the Eurasian Patent Office made comments on certain issues.

Further discussion of the Draft Law will be continued at the next meeting of the working group.


The Protocol on the Protection of Industrial Designs was adopted on September 9, 2019 at the diplomatic conference in Nur-Sultan, Kazakhstan.

In May this year, the Protocol was ratified by the Republic of Azerbaijan and the Republic of Armenia.

The Protocol will enter into force with respect to the first three States, which have ratified it or acceded to it, three months after the instrument of ratification or accession has been deposited by a third State with its depositary – the Director General of the World Intellectual Property Organization.
