Development of IP system in the age of artificial intelligence was discussed in Astana

At the Astana International Forum, EAPO President Grigory Ivliev presented the Eurasian Patent Office’s approaches to patenting technical solutions involving AI.

The basic norms of patent law do not allow software, mathematical methods, and algorithms per se to be recognized as inventions.

A patent may be granted if the AI possesses functions that technically contribute to the state of the art. The decision to classify a particular technical solution as an invention and to assess its novelty is made as a whole, not based on individual features. Non-technical features are excluded from protection. However, they may interact with technical features to ensure a technical solution.

“The EAPO has a fairly flexible approache. At the same time, our methodology is in demand in the IT sector and fully coincides with the practice of the world’s leading IP5 offices. Our examination is fully consistent with the national agenda of the participating states to promote the development and implementation of AI tools,” Grigory Ivliev noted.

Grigory Ivliev had a meeting with WIPO Director General Daren Tang on the sidelines of the forum.

During the meeting, the parties discussed the EAPO-WIPO pilot project on enhancing IP commercialization capacity of technoparks, EAPO and WIPO’s educational initiatives, multilingualism, and the promotion of the Russian language in the registration systems.

EAPO President also met with Christine Hambaryan, Head of the Intellectual Property Office of the Ministry of Economy of the Republic of Armenia, and Sanan Tapdigov, Deputy Chairman of the Board of the Intellectual Property Agency of the Republic of Azerbaijan. They discussed prospects for future cooperation.

Astana International Forum (AIF 2025) is the largest international dialogue platform in Kazakhstan, which brings together the world’s leaders, examiners, scholars and business representatives to support multilateral cooperation and find actionable solutions to global problems. IP examiners from France, Macedonia, Morocco and China took part in the forum. This year’s topic is “Connecting minds, shaping the future.”
